Privacy notice on the processing of prospective product/service customers’ personal data
As Emlak Konut Gayrimenkul Yatırım Ortaklığı A.Ş., acting as Data Controller, we wish to inform you under Article 10 of Personal Data Protection Law No. 6698 (“KVKK”), entitled “Data Controller’s Obligation to Inform”. The Law was published in Official Gazette No. 29677 on 7 April 2016 to protect individuals’ fundamental rights and freedoms, particularly the privacy of private life, in the processing of personal data, and to determine the obligations of natural and legal persons processing such data.
Data controller and its representative
Under the Law, “Emlak Konut Gayrimenkul Yatırım Ortaklığı A.Ş.”, operating at “Barbaros Mah. Mor Sümbül Sok. No:7/2 B (Batı Ataşehir) Ataşehir - Istanbul” (hereinafter referred to as the “Company” or “Emlak Konut”), is the Data Controller.
Your personal data processed
The following personal data is processed in connection with your use of our Company’s products and services:
- Identity Information (your identifying details such as first name, surname and Turkish Republic identity number),
- Contact Information (your address, mobile phone number, email address and other contact details),
- Audio-Visual Records
- Transaction Security (such as website browsing data, IP address, website login/logout information, and passwords and passcodes)
- Other Data (such as your account details and IBAN declared in the Property Request and Preliminary Allocation Form, and other personal data you provide directly in surveys, suggestions and complaints)
Purpose of processing personal data
Your personal data is processed so that you can benefit from the services we provide as Emlak Konut, in accordance with the fundamental principles set out in the Personal Data Protection Law and relevant legislation, based on your explicit consent and/or other circumstances specified in Article 5(2) of the Personal Data Protection Law; particularly the legislation to which we are subject. Given the services provided by Emlak Konut, your personal data will be processed to enable us to provide you with these services for the following purposes:
- Conducting marketing analysis studies,
- Managing the sales processes for goods/services,
- Keeping Audio-Visual Records
- Managing the marketing processes for products/services,
- Managing advertising/campaign/promotion processes,
- Managing customer relationship management processes,
- Conducting customer satisfaction activities,
- Monitoring requests/complaints,
- Planning and carrying out customer-specific sales and marketing activities (for guests and customers who have consented to commercial electronic communications, analysing their preferences, interests and needs and providing tailored promotions, opportunities and benefits). These purposes will be pursued in accordance with the personal data processing conditions and general principles set out in Articles 4, 5 and 6 of Law No. 6698.
Method of collecting personal data and legal grounds
Your personal data may be collected verbally, in writing or electronically, in accordance with the Law, through channels such as Emlak Konut websites, sales and marketing units, telephone/call-centre conversations, the Property Request and Preliminary Allocation Form, and preliminary property sale agreements. We process the personal data collected through the above methods on the basis of one or more of the following legal grounds:
- Your explicit consent (for advertising, promotion and marketing activities, and commercial communications),
- The necessity of processing the personal data of parties to a contract in order to conclude a preliminary property sale agreement,
- The necessity of complying with a legal obligation (Law No. 5651 on Regulation of Publications on the Internet and Combating Crimes Committed by Means of Such Publications),
- Your having made your personal data public,
- The necessity of processing your personal data for our legitimate interests, provided that your fundamental rights and freedoms are not harmed.
Parties to whom processed personal data is transferred and purposes of transfer
Our Company processes your personal data lawfully and fairly, ensuring that it is accurate and, where necessary, up to date; collected for specific, explicit and legitimate purposes; relevant, limited and proportionate to those purposes; and retained only for the period required by the purpose or applicable legislation. Personal data processed with your explicit consent will be retained for as long as you do not withdraw that consent. You may withdraw your explicit consent at any time.
Rights of the person whose personal data is processed
If the party to this Agreement is a natural person, the Customer may exercise the following rights by applying to Emlak Konut pursuant to Article 11 of Law No. 6698. If the party is a legal entity, the Customer’s authorised representatives may exercise these rights in relation to their personal data:
- To learn whether personal data is processed,
- To request information if personal data has been processed,
- To learn the purpose of processing personal data and whether it is used in accordance with that purpose,
- To know the third parties to whom personal data is transferred domestically or abroad,
- To request correction of incomplete or inaccurately processed personal data,
- To request deletion or destruction of personal data,
- To request that third parties to whom personal data was transferred be notified of any correction, deletion or destruction,
- To object to an adverse outcome arising from analysis of processed data exclusively through automated systems,
- To claim compensation for damage suffered as a result of unlawful processing of personal data.
Under Article 4 of Personal Data Protection Law No. 6698, the personal data we collect and process must be accurate and, where necessary, up to date. Therefore, if any of your personal data changes, you may provide us with your current and accurate personal information through the methods set out below.
If you would like to contact us about your requests
For written applications:
- You may submit a wet-signed copy of the “Personal Data Protection Law Application Form” available on our website at https://www.emlakkonut.com.tr/ in person with a document identifying you, or through a representative holding a notarised power of attorney proving authorisation to apply regarding the rights under Article 11; alternatively, you may send your application through a notary to “Barbaros Mah. Mor Sümbül Sok. No:7/2 B (Batı Ataşehir) Ataşehir - Istanbul”.
For electronic applications:
- You may sign the Personal Data Protection Law Application Form with an electronic or mobile signature using a “secure electronic signature” certificate as defined by Electronic Signature Law No. 5070, and send it to our Company’s Registered Electronic Mail address (emlakkonut@hs01.kep.tr); alternatively, you may use an email address previously provided to our Company and registered in our systems to send it to info@emlakkonut.com.tr.
We will respond to requests submitted to our Company as soon as possible and no later than thirty days, in writing or electronically, depending on the nature of your request.
